OGDEN — The murder trial of a 16-year-old gang member is under way here.

Opening statements were given Monday afternoon in the trial of Diego Mora, accused in the September 2007 slaying of 22-year-old Jesus Aparicio.

Police said Mora, then 15, got into a fight with Aparicio in the parking lot of the Kicks 66 gas station on Washington Boulevard. As he tried to run away, police said Mora shot Aparicio in the back.

Mora is accused of killing Aparicio to raise his status in his gang. Weber County prosecutors successfully got him certified as an adult to face the charges.

Mora has rejected a pair of plea deals, insisting that he go to trial on the first-degree felony murder charge. He will face trial on an aggravated robbery charge at a later date.

The trial will be scattered across the month of October with witness testimony expected to begin Oct. 2.
